1. Acceptance of Terms

By accessing or using Smart AIPI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Smart AIPI provides an OpenAI-compatible API gateway that allows you to access AI language models, image generation, and video generation capabilities at reduced cost. The Service acts as a proxy and does not itself generate AI outputs.

3. Account Registration

You must provide accurate information when creating an account.
You are responsible for maintaining the security of your API keys and account credentials.
You must be at least 18 years old to use the Service.
One account per person. Duplicate accounts created to abuse free credits may be terminated.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose
Generate content that violates OpenAI's usage policies
Attempt to circumvent rate limits, billing, or access controls
Resell or redistribute access to the Service without authorization
Interfere with or disrupt the Service infrastructure
Use automated means to create multiple accounts for free credit abuse

5. Billing and Credits

The Service uses a prepaid credit system. You purchase credits which are deducted based on API usage.
Pricing is listed on our website and may change with notice.
Free credits are promotional and may expire. Expiry dates are shown on your dashboard.
Purchased credits do not expire.
Refunds are handled on a case-by-case basis. Contact support for refund requests.
All prices are in USD.

6. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party AI providers and infrastructure. We are not liable for downtime caused by upstream providers, network issues, or scheduled maintenance.

7. Intellectual Property

You retain all rights to the inputs you provide and the outputs you receive through the Service. Smart AIPI does not claim ownership of your content. The Service itself, including its software, branding, and documentation, is owned by Smart AIPI.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART AIPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE.

9. Termination

We may suspend or terminate your account if you violate these terms. You may close your account at any time by contacting support. Upon termination, unused purchased credits may be refunded at our discretion.

10. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify registered users of material changes via email.

11. Governing Law

These terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first.
